Receive debtor details from client and setup on Newcomen's Debt Recovery System.
Demand letter under Newcomen Commercial Services letterhead.
Demand letter under solicitor letterhead.
If no response to written contact. A physical attendance can be made to the debtor's address. Cost referred to client.
This is a letter of authority signed by the client and returned to Newcomen, confirming legal action should commence.
Statement of Claim issued through NSW Court's and served on debtor. Debtor has 28 days after service to respond in the appropriate manner.
Cover letter to Statement of Claim.
After 28 days from Service, unless appropriate actions were taken by the debtor, the Court will confirm Judgement to be registered in favour of the Creditor, allowing further legal action to be taken as follows.
Advice to debtor that judgement has been entered and that further action is to ensue.
NSW Sheriff is activated, they are authorised to seize debtors possessions to repay the Judgement debt.
A Garnishee can be placed on Debtors wages or bank account at this time.
Judgement debtor summonsed to Court to be examined on their financial circumstances, with the view to repayment arrangement.
Bankruptcy proceedings begun in the Federal Magistrates. Very much a last resort.
Creditors Petition hearing in Federal Court.
